CPS Attorneys specialists prepared a memorandum on the possibility of collecting debts of a shipyard in the framework of bankruptcy proceedings

The Client, the shipowner company, referred to CPS Attorneys in connection with the necessity to prepare a memorandum on the possibility of recovering the debts of the shipyard during the bankruptcy procedure and obtaining a partially finished hull of a river-sea type vessel.

 

The Client ordered the shipyard to build a hull of the river-sea type vessel and made a full payment under the contract. In the process of fulfilling the order, the shipyard hired a subcontractor to build the hull of the vessel. Before the construction of the vessel hull was completed, a bankruptcy procedure was initiated against the general contractor. The company-subcontractor completed the construction of the hull for 90%, but did not receive a full payment for the construction from the general contractor.

 

CPS Attorneys specialists prepared a memorandum, in which they offered the Client the most effective steps to recover the debts of the shipyard, taking into account the initiated bankruptcy procedure, as well as obtaining a partially finished hull from the subcontractor.
